Construction Disputes

When disputes between engineers, builders, architects and owners are litigated significant amounts of time and money are spent. Mediation helps parties in dispute maintain or reestablish working relationships which enhances negotiation and productivity.

Mediation is a non-adversarial, cost effective and timely process where the parties in dispute maintain control of the process and reach a resolution together. Mediation is confidential. What happens in mediation stays in mediation.

In the alternative, litigation is an adversarial process, which increases stress and anxiety, and where the parties hand over control of the dispute to a stranger. Additionally, the courtroom and court record are open to the public.

Parties participating in mediation pay per session as they go. Mediation does not require retainers in comparison to litigation in which parties must pay large legal fees up front. Parties usually split the cost of the mediation session rather than each party hiring its own attorney.

Mediation is voluntary. If it isn’t working, participants can stop and not affect their right to litigate. Should parties already be involved in litigation the parties may simultaneously try mediation. Parties involved in litigation may bring an attorney to mediation to serve as a consultant.

It is possible to schedule a mediation the same week you call. Daytime, evening and some weekend appointments are available.

It is also possible to resolve a dispute in one session.
